Türkiye: Secure Property Payment Mandatory 1 Dec 2026
Region: TürkiyeHesaplayıcı
On 1 October 2026 Türkiye’s Official Gazette set 1 December 2026 as the day secure payment becomes mandatory on a property sale. Until then the system is optional. The price is paid so title and money change hands together. The fee comes off the seller’s proceeds; excluded sales and the amount are left to a protocol.
When does secure payment become mandatory?
The amendment in the Official Gazette of 1 October 2026, issue 33387, took effect that day. It replaced 1 July 2026 with 1 December 2026 in paragraph 10 of provisional article 1 of the Regulation on Real Estate Trade. A property sale made until 1 December 2026 need not use the payment system in additional article 1. The Ministry of Trade may postpone that date by up to three months.
The Official Gazette of 29 April 2026, issue 33238, created the system and left sales until 1 July 2026 outside the obligation. On 28 September 2026 the Ministry said the banks’ technical setup was still unfinished, so the system could not yet run without interruption, and that the mandatory start would be 1 December 2026.
How does the sale price move?
Additional article 1 covers sales by real-estate businesses and by other natural or legal persons. When part or all of the price is paid in cash, by wire transfer, by electronic funds transfer, or by another method the Ministry sets, the price goes through the payment system. The system is built so the title and the sale price change hands at the same time.
If a bank under Banking Law no. 5411, or a financing or savings-financing company under Law no. 6361, lends part or all of the price, the loan amount stays outside the system. The rest of the payment uses the system.
Who pays the fee, and which sales are in the pilot?
Every transaction on the system carries a usage fee. The fee is deducted from the sale price transferred to the seller. The regulation does not state the amount.
The October amendment has the Ministry authorize an integrator to set up and run the system and to produce statistics. The system is established under a protocol signed by the Ministry of Trade, the relevant units of the Ministry of Environment, Urbanization and Climate Change, and that integrator. The protocol decides which sales stay out, whether a pilot is required and what it covers, the usage fee, and how the fee is shared. The Official Gazette names no province and no fee. The 28 September statement says a pilot will start once the banks are ready; it names no province either.
Did the commission or the title deed fee change?
This amendment does not change the cap on the estate agent’s commission or the title deed fee rate. Work out the commission with the real estate commission calculator; the rules are in the guide to the commission. The title deed fee is paid separately: the amount is on the title deed fee calculator, and the other costs are in the guide to title deed costs.
