The total rate is the commission both parties pay together, as a share of the sale price or of one month’s rent. It is at most 4% on a sale and at most 100%, one month’s rent, on a rental (Regulation art. 20). The general VAT rate is 20%. The payment per party assumes an equal split.
Worked example
The worked example on this page shows the legal cap on a sale of 2,000,000 TRY: both parties together pay 4% of the price, 2% each. The steps give the commission, the VAT, the total with VAT and the payment per party.
Limits
The calculator covers the agent’s commission and its VAT only; the title deed fee, the land registry service fee and loan costs are not included. The parties may agree on a lower fee or another split. Under the regulation the fee is earned when the sale is registered at the land registry or the lease is made. Amounts are rounded to the kuruş.
Frequently Asked Questions
What is the maximum real estate commission in Türkiye?
On a sale, 4% of the sale price without VAT; on a rental, one month's rent without VAT. The caps are in art. 20 of the Regulation on Real Estate Trade.
Does the buyer or the seller pay the commission?
Unless agreed otherwise in writing, they pay equal halves: 2% each on a sale. The total cannot exceed 4%.
Is VAT added to the commission?
Yes. The legal caps exclude VAT; 20% VAT is added to the commission.
Who pays the commission on a rental?
Unless agreed otherwise, the landlord and the tenant pay equal halves. The total cannot exceed one month's rent without VAT.
Calculation rules
- Regulation on Real Estate Trade (Taşınmaz Ticareti Hakkında Yönetmelik) art. 20: the fee cannot exceed 4% of the sale price or one month’s rent, both without VAT. Unless agreed otherwise in writing, the parties pay equal halves.
- The rate is the total of both parties: on a sale, 4% means 2% for the buyer and 2% for the seller. A rate above the cap is rejected.
- The general VAT (KDV) rate is 20% (Presidential Decree 7346, since 10 July 2023).
- The amounts per party assume an equal split; the parties may agree on another split.
- Amounts are rounded to the kuruş; the rate is used with at most two decimals.
