Definition

Tenant (Kiracı): The party to a lease who pays the agreed rent in return for the use of a thing.

The tenant is the party to a lease who pays the agreed rent in return for the use of a thing. The tenant appears in rent increase and withholding calculations: a cap on the yearly increase limits what the tenant pays at renewal, and a tenant who must withhold tax pays the landlord the rent less the tax.

Where it appears in the formulas

maximum new rent = current rent × (1 + CPI 12-month average change). The rent increase calculator applies the cap of the renewal month. The parties can always agree on a smaller increase.

In Türkiye

The Turkish Code of Obligations no. 6098 defines the tenant (kiracı) in art. 299. For homes and roofed workplaces, the increase in a renewed year cannot exceed the CPI 12-month average change: a 25,000 TRY rent renewed in September 2026 can rise to at most 32,947.50 TRY, an increase of 7,947.50 TRY. Some business tenants withhold tax from the rent.
